The future of Bakkies Botha is still unsettled and there are reports that French club Toulon have sent the contract,  allegedly signed by Botha last month,  to SA Rugby and that the player was expected to join the club yesterday.

SA Rugby legal affairs GM Christo Ferreira however has told Business Day  that he had not received the contract.

National team manager Andy Marinos told Business Day: ‘We certainly don’t want to see Bakkies playing overseas and we met him recently to discuss the matter.”

“He has a contract with SA Rugby to play for the national team.’

Ferreira says that Botha can only join Toulouse if SA Rugby released him from his contract.

In addition The Bulls would also have to sign a release form to free the Bakkies from his provincial contract and that in turn would have to be signed by SA Rugby – which will not happen, given the Bulls’ insistence that Botha has to honour the contract.

This means Toulon’s only option would be to sue Botha for breach of contract if he has in fact signed the contract with them.

Bakkies could also “just up and leave” South Africa and play in France with Victor Matfield but then he would obviously get sued by the Bulls and SARugby.

Blue Bulls Rugby Union CEO Barend van Graan refuses to become entangled in the and yesterday said: ‘I do not want to comment.

“All I have to say is that Bakkies is playing for us.’
